Welcome to Beyond Basic Learning, a service operated by Beyond Basic Enterprise, Inc. ("Company," "we," "us," or "our"). By accessing or using our website, tools, educational resources, consulting services, or any other services offered through beyondbasiclearning.com (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Services.

1. Nature of Services — Educational Purposes Only

The information, tools, calculators, reports, masterclasses, coaching sessions, and all other content provided through Beyond Basic Learning are intended for general educational and informational purposes only. They do not constitute, and shall not be construed as, professional, legal, financial, architectural, engineering, or regulatory advice.

State and local regulations governing childcare facilities, including but not limited to space requirements, staff-to-child ratios, zoning laws, building codes, and licensing standards, are subject to change without notice. While we make every reasonable effort to provide accurate and current information, we make no warranties or representations regarding the completeness, accuracy, reliability, or applicability of any information provided through the Services.

2. Professional Consultation Requirement

Before making any business, financial, operational, or regulatory decisions regarding a childcare facility or early childhood education program, you should consult with appropriately licensed and qualified professionals, including but not limited to:

• A licensed attorney familiar with your state's childcare licensing laws, business formation, and regulatory compliance
• A certified public accountant (CPA) or qualified financial advisor for financial planning and tax matters
• A licensed architect or professional engineer for building design, space planning, and code compliance
• Your state's childcare licensing authority for current regulatory requirements and application procedures
• A licensed insurance professional for appropriate business and liability coverage

You acknowledge and agree that any reliance on information provided through the Services is at your own risk.

3. User Accounts and Registration

Certain features of the Services may require you to create an account or provide personal information. You agree to provide accurate, current, and complete information and to update such information as necessary. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment Terms and Refund Policy

All purchases are final. Once payment is processed for any Service, including but not limited to Space Calculator search bundles, Masterclass enrollments, consulting sessions, and digital resources, no refunds will be issued.

However, at the sole and absolute discretion of Beyond Basic Enterprise, Inc., a credit may be issued for additional service time, future use of the Services, or toward the purchase of other offerings. Credit requests must be submitted in writing to [email protected] within thirty (30) days of the original purchase date.

All prices are listed in United States Dollars (USD). We reserve the right to change pricing at any time without prior notice. Price changes will not affect purchases already completed.

5. Intellectual Property

All content, materials, tools, calculators, reports, course materials, branding, logos, and other intellectual property available through the Services are the exclusive property of Beyond Basic Enterprise, Inc. and are protected by United States and international copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of our materials without our prior written consent, except as follows:

• You may download or print one copy of materials for your personal, non-commercial use
• Reports generated through our tools are licensed for your internal business planning purposes only

6. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, BEYOND BASIC ENTERPRISE, INC., ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Your access to or use of, or inability to access or use, the Services
• Any conduct or content of any third party on the Services
• Any content obtained from the Services
• Unauthorized access, use, or alteration of your transmissions or content
• Any business decisions made based on information provided through the Services

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM.

7. Indemnification

You agree to defend, indemnify, and hold harmless Beyond Basic Enterprise, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Services.

Your use of the Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our practices regarding the collection, use, and protection of your personal information.

9. Modifications to Terms
